TAPIR

Terms of Use

The agreement between you and Tapir. Section 3 is the one that matters most.

Effective 26 August 2026 · Version 2026-08-27

The short version

  • Tapir coaches running. It is not a doctor and it cannot tell whether exercise is safe for you.
  • Running carries risk. You accept that risk, and you are responsible for stopping.
  • The app is yours to use, not to resell, scrape, or take apart.
  • Your training data is yours. We claim no ownership of it.
  • Disputes go to arbitration in New York unless you opt out within 30 days, which you can do by sending one email.
  • Nothing here takes away a consumer right your local law gives you, and nothing limits our liability for death or personal injury.

1. Agreeing to this

By downloading, installing or using Tapir you agree to these terms. If you do not agree, do not use it. If you are using Tapir on behalf of an organisation, you are confirming you can bind that organisation.

These terms and the Privacy Policy are the whole agreement between you and Tapir on this subject.

2. Who can use it

You must be at least 16 years old. You must not be located in a country subject to a United States government embargo, or listed on any United States government list of prohibited or restricted parties.

3. Health, safety, and the thing you must actually read

Tapir is a fitness product. It is not a medical device, it is not medical advice, and it is not a substitute for a doctor or a physiotherapist. It cannot examine you, it does not know your medical history, and it cannot tell whether exercise is safe for you.

Talk to a doctor before you start if you have or suspect a heart condition, high blood pressure, a chronic illness, an injury, or any other reason to think that increasing your exercise might be unsafe. Do the same if you are pregnant, if you are recovering from surgery or illness, or if you are returning after a long time away from exercise.

Stop immediately and get medical help if you experience chest pain or pressure, pain radiating into the arm or jaw, severe breathlessness, dizziness, fainting, an irregular heartbeat, or any sudden or severe pain. A training plan is never a reason to keep going through any of those.

You decide, not the app. Every session Tapir prescribes is a suggestion. You are responsible for judging whether to do it, for how you do it, and for stopping when your body says so. Running, and endurance training in particular, carries an inherent risk of injury and, rarely, of serious harm or death. By using Tapir you accept that risk knowingly and voluntarily.

Fuelling guidance is general. Carbohydrate figures are typical ranges for the duration and intensity of a session. They are not a nutrition plan, they take no account of any medical or dietary condition, and they are not suitable for anybody managing diabetes or an eating disorder without professional advice.

4. Your account

Tapir works without an account. If you make one, keep access to your sign-in method secure and tell us promptly if you think somebody else has it. You are responsible for what happens under your account, except where it is our fault.

You can delete your account and everything in it from inside the app, in one step, at any time. Deletion is immediate and permanent.

5. What you may and may not do

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use Tapir on devices you own or control, for your own training.

You may not:

6. Who owns what

Your data is yours. Your training history, your notes, and anything else you put into Tapir belong to you. We claim no ownership. You grant us only the licence we need to run the service for you: to store your data, process it to generate your plan, and show it to the people you explicitly choose to share it with. That licence ends when you delete the data.

The app is ours. Tapir, its name, its design, its coaching engine and the Tapir character remain our property. The published sports-science formulas we release separately as open source are governed by their own licence, not by this one.

Feedback you send us we may use freely and without obligation, so please do not send us anything confidential.

7. Connected services

If you connect any service in future, you will also accept that service's terms, and what it does with your data will be governed by its policies rather than ours. We are not responsible for a third-party service being unavailable, changing its API, or ending your access. You can disconnect at any time, which deletes what we imported from it.

8. Paid features

What is free, and stays free

Your training plan, the weekly adjustments, the check-ins, the strength and mobility guidance, and the science behind all of it are free. They are not a trial and they do not become paid later. If that ever changes for new users, it will not change for you.

What costs money

One thing: the coach, the part you talk to in your own words, which reads your plan and proposes changes to it. It is $6.99 a month. It is the only paid feature because it is the only part of Tapir that costs us money every time somebody uses it.

A subscription includes up to 60 messages a week. That is far more than normal use and exists to stop runaway or automated use rather than to ration the service; if you reach it, the allowance resets on Monday and everything else in the app keeps working. We may also limit the length of an individual message. Nothing you have already paid for is lost when a limit applies.

What the coach is not

It is software, not a person. It uses a large language model, it can be wrong, and it is not a coach, a physiotherapist, a doctor or a dietitian. It will not diagnose you, treat you, or tell you whether an injury is serious, and section 3 above applies to everything it says. Any change it proposes is checked against the same safety rules as the rest of the app, and no change is made to your plan unless you accept it.

The free trial

New subscribers get 14 days free. The trial starts when you take it, and unless you cancel at least 24 hours before it ends it becomes a paid monthly subscription at $6.99 and you are charged then. Nothing is charged during the trial itself.

Cancel in Settings → your name → Subscriptions on your device, which is where Apple keeps it, not in Tapir. Cancelling during the trial keeps the coach until the trial's last day and then stops it; you are not charged.

One trial per person. Apple decides who is eligible, per Apple ID and per subscription group, and if you have used a Tapir trial before you will be charged the normal price instead. Apple's own purchase screen shows you the price before anything is confirmed, so check it there if you are unsure.

How it is billed

Paid features are sold through the app store you installed from: the Apple App Store, or Google Play on Android. That store takes the payment, manages the subscription, and its refund policy applies; we cannot process a refund ourselves. Subscriptions renew automatically until you cancel them in your account settings with that store, and cancelling takes effect at the end of the period you have paid for. Prices may change, and we will tell you before a change affects a renewal.

Deleting your Tapir account does not cancel your subscription. The store holds it, not us, so you must cancel it there or billing continues. This is worth reading twice, because it is the one place where deleting everything is not enough.

If you are a consumer in the UK or the EU

You normally have 14 days to withdraw from a purchase of digital content without giving a reason. Where you ask us to start supplying immediately and acknowledge that you lose that right by doing so, it does not apply. Where it does apply, tell us within 14 days and we will arrange the refund through Apple. Nothing in this agreement removes a statutory right you have as a consumer.

If you are in California

Automatic renewal terms, the cost, and how to cancel are disclosed before you buy and confirmed in writing afterwards, as California's Automatic Renewal Law requires. You cancel in your App Store account settings, which takes effect at the end of the current period. Under California Civil Code section 1789.3 you may also contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.

9. Things you post

If you use the social features, what you share with the people you choose is yours and stays yours. Do not post anything unlawful, harassing, or that you do not have the right to share. We may remove content that breaks these terms or that we are legally required to remove, and we will tell you when we are permitted to.

Tapir never shows another athlete's imported activity data to you, or yours to them. The social features read Tapir's own session records only. This is both a promise to you and a condition of the agreements we have with the services you can connect.

10. Copyright

If you believe something in Tapir infringes your copyright, send a notice under the Digital Millennium Copyright Act to legal@tapirapp.com, addressed to the Copyright Agent. Include the work you say is infringed, where the material is, your contact details, a statement of good-faith belief, a statement under penalty of perjury that the notice is accurate and you are authorised to act, and your signature. We respond to valid notices and terminate repeat infringers.

11. Pre-release software

Anything offered as a beta, preview or test build is provided for evaluation, may change or be withdrawn, and may contain errors that a released version would not. It is excluded from any warranty, and data created in a pre-release build may not carry over.

12. Availability

We try to keep Tapir running and we do not promise that it always will be. The app is built to work offline for exactly this reason: your plan lives on your phone, so our servers being down does not stop you training. We may change or discontinue features, and if we ever discontinue the service we will give reasonable notice and a way to export your data.

13. Disclaimer of warranties

To the fullest extent the law allows, Tapir is provided as is and as available, without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that its estimates and predictions will be accurate. Fitness estimates are estimates and can be wrong.

Some jurisdictions do not allow the exclusion of implied warranties, so some of this may not apply to you. Nothing here limits rights you have as a consumer that cannot be limited by agreement.

14. Limitation of liability

To the fullest extent the law allows, Tapir will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data, or the cost of substitute services, arising out of your use of the app.

Our total liability for any claim relating to Tapir is limited to the greater of the amount you paid us in the twelve months before the claim, or fifty United States dollars.

Nothing in this section limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited. If you are a consumer in the UK or EU, your statutory rights are unaffected by anything in this agreement.

15. Indemnity

You agree to indemnify Tapir against claims arising from your misuse of the app, your breach of these terms, or your violation of anybody else's rights. This does not apply to the extent the claim results from our own conduct, and it does not apply to consumers where local law prohibits it.

16. Ending it

You can stop using Tapir at any time and delete everything from inside the app. We may suspend or end your access if you materially breach these terms, if we are legally required to, or if we discontinue the service. Where it is practical and lawful we will warn you first and give you a chance to export your data. Sections 6, 13, 14 and 15 survive the end of this agreement.

17. Governing law and disputes

These terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules.

Informal resolution first. Email legal@tapirapp.com and give us 30 days. Most things end here.

Arbitration. If that fails, any dispute will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in New York County, New York, or conducted remotely at your election. Judgment on the award may be entered in any court with jurisdiction.

You can opt out. Send an email titled "Arbitration opt-out" to legal@tapirapp.com within 30 days of first accepting these terms and this section will not apply to you. Nothing else changes if you do, and we will not treat you differently for it.

Class action waiver. Disputes are brought individually, not as a class, collective or representative action. If this waiver is held unenforceable as to a particular claim, that claim proceeds in court rather than in arbitration.

Small claims. Either of us may bring a qualifying claim in small claims court instead.

Injunctions. Either of us may ask a court for an injunction to stop infringement or misuse of intellectual property without first going to arbitration.

Time limit. Any claim relating to Tapir must be brought within one year of when it arose, except where a longer period is required by law and cannot be shortened by agreement. If you are a consumer whose local law gives you longer, that applies instead.

If you are a consumer in the UK or the EU, this section does not deprive you of the right to bring proceedings in the courts of the country where you live, or of the protection of that country's mandatory consumer law.

18. Apple

This agreement is between you and Tapir, not Apple, and Apple is not responsible for the app or its content. Apple has no obligation to provide support for Tapir. If the app fails to conform to any applicable warranty, you may tell Apple and Apple will refund the purchase price if there was one; to the maximum extent the law allows, Apple has no other warranty obligation. Tapir, not Apple, is responsible for any claim that the app infringes intellectual property rights, and for any product liability or regulatory claim relating to the app. Apple and its subsidiaries are third-party beneficiaries of this agreement and may enforce it against you.

19. Everything else

If a provision is found unenforceable, the rest stays in force. If we do not enforce something immediately, we have not given it up. You may not transfer this agreement; we may transfer it as part of a merger or sale of the business, on notice to you.

We may update these terms. If a change materially affects you we will tell you in the app before it takes effect, and continuing to use Tapir after that is how you accept it. If you do not accept it, delete the app.

20. Housekeeping

Notices. We contact you in the app, or at the email address on your account if you have one. You contact us at legal@tapirapp.com. Notices are effective when sent.

Export control. You confirm you are not located in, and will not use Tapir in, a country subject to a United States government embargo or designated as supporting terrorism, and that you are not on any United States government list of prohibited or restricted parties.

Government users. Tapir is commercial computer software. United States government users receive only the rights given to all other users, under FAR 12.212 and DFARS 227.7202.

Force majeure. Neither of us is liable for failing to perform because of something genuinely outside our reasonable control, such as a natural disaster, war, an outage at a provider we depend on, or a change in the law.

Third parties. Nobody other than you and Tapir has rights under this agreement, except Apple as described in section 18.

Headings are for convenience and do not affect meaning. Language: the English version governs if a translation disagrees with it.
